The regular monthly meeting of the Franklin Town Board was called to order at 7:30 p.m. by Supervisor Jeff Taggart. Present were Don Smith, Garret Sitts, David Grant, Lisa Huyck, Supervisor Jeff Taggart, Highway Superintendent Mark Laing and Paul Warner. Also present was Shane Strong, Kaima Nelson Bowne, Jan Mulroy, Tim Mulroy, William Young, Dawn Ritz, Mike Howland, Linda Bevilacqua, Pete Bevilacqua, Mike Wallace, Dwight Bruno, Nancy Cloonan, John Cloonan, Jamie Archibald, Liz Serrao, Jason Starr, Paul DeAndrea, Brian Brock, Roger Reed, Tony Breuer, Thomas Colllier, John Alessi, Rose Cleaveland, Maureen McQuillian Jones, Stephen Jones and reporter Robert Cairns.
The minutes from the March 3, 2015 meeting were read. Don Smith made a motion to accept the minutes as read. Garret Sitts seconded the motion and all agreed.
Highway Superintendent Mark Laing opened the bids for the trucking of crushed limestone and the purchasing of diesel fuel, heating oil, pipe and liquid calcium chloride. Carver Sand & Gravel LLC bid $8.60/ton to deliver all stone products. Cobleskill Stone Products bid $8.25/ton to deliver all stone products. Hanson bid $17.74/ton for1a, $17.75/ton for 1b, $16.75/ton for 1st and $16.75/ton for 1&2 mix. The HansonTrucking bid was for the cost and delivery of the stone products.
After combining the price of stone with the trucking charges the cost is as follows.

Garret Sitts made a motion to accept the bid of $17.75/ton from Hanson Trucking for stone product 1a and the bid of $16.25/ton from Cobleskill Stone Products for stone products 1b and 1st and the bid of $16.35/ton from Cobleskill Stone Products for stone product 1&2 mix. David Grant seconded the motion and all agreed.
Mirabito Energy Products submitted the only bid for fuel oil and heating oil. They bid a fixed price of $2.4539/gallon for heating oil and a fluctuating price of rack plus $.27l5/gallon. For low sulfur diesel they bid a fixed price of $2.3082/gallon and a fluctuating price of rack plus $.2211/gallon. For winter blend diesel they bid a fixed price of $2.597O/ gallon and a fluctuating price of rack plus $.2511/ gallon. Garret Sitts made a motion to accept the firm bids of $2.4539/gallon for heating oil, $2.3082/gallon for low sulfur diesel and $2.5970/gallon for winter blend diesel. David Grant seconded the motion and all agreed.
Three bids were received for liquid calcium chloride. Gorman Brothers bid $.82/ gallon, Peckham Materials Corporation bid $.803/gallon and Suit-Kote bid $1.19/gallon. Garret Sitts made a motion to accept the bid of $.803/gallon delivered and applied from Peckham Materials Corporation. David Grant seconded the motion and all agreed.
Steel Sales, Inc. in Sherburne submitted the only bid for pipe.

Don Smith made a motion to review the price at the County and to purchase pipe from Steel Sales, Inc. if less expensive than the County bid and to use the County bid if Steel Sales, Inc.’s bid is more expensive. Garret Sitts seconded the motion and all agreed.
Don Smith made a motion to go into executive session regarding legal matters at 8:00 p.m. Lisa Huyck seconded the motion and all agreed. Garret Sitts made a motion to go out of executive session at 8:10 p.m. David Grant seconded the motion and all agreed.
Lisa Huyck made a motion to change legal counsel to Coughlin & Gerhart LLP. David Grant seconded the motion and all agreed.
Lisa Huyck reported for the Kellogg Trust. Four new dugouts have been ordered and are being built by students from the Milford BOCES. Tweedie Construction will be repairing the embankment by the footbridge.
In regards to the proposed roundabout at the intersection of New York State Route 357 and Route 28, Mike Howland stated he would rather not have the bypass lane that would allow traffic coming from Oneonta going to Franklin to avoid the roundabout. The Town Board did not take a position on the issue.
Mike Wallace would like additional road signs placed on Case Hill Road.
Tim Mulroy expressed his concern about the impact on the forest and wildlife habitat due to the clearing of trees to build a pipeline.
Jason Starr would like a noise ordinance adopted. All Board members indicated that they were against a noise ordinance.
Supervisor Jeff Taggart offered a resolution stating the Town Board of Franklin is against a compressor station being situated in the town of Franklin until all environmental questions have been satisfied. Garret Sitts made a motion to adopt the resolution. Lisa Huyck seconded the motion and all agreed.
Garret Sitts made a motion to have a public hearing for a local law governing the sale, application, and disposal of waste associated with oil and natural gas exploration, extraction and storage activities to be held on May 5, 2015 at 7:00 p.m. David Grant seconded the motion and all agreed.
Mark Laing reported for the Highway Department. He would like to have a smoke and heat detector system installed at the Town Garage. He received an estimate of $10,665.03 for the installation of a system from ZS Security. Mark would like to rent a grader at the cost of $4,500.00/month. Lisa Huyck made a motion to rent a grader. David Grant seconded the motion and all agreed.
The purchase of equipment was discussed. Mark would like to purchase an excavator, a dual-wheel truck and a dump box. David Grant made a motion to advertise for bids for a dual-wheel truck and a dump box. Lisa Huyck seconded the motion and all agreed.
Garret Sitts reported for the Recreation Committee. A pool director has been hired.
Jeff Taggart reported for the Planning Board. There will be a public hearing in March for a wedding venue on Post Road. In May there will be a public hearing for a medical office on County Route 21.
Vouchers were submitted for audit and payment.
With no further business to come before the Board, Garret Sitts moved for adjournment at 10:00 p.m. David Grant seconded the motion and all agreed.
